Well hello there! Welcome to Nifty250. We urge you to read through all our terms and conditions below, in order to better understand our commitments to you as the awesome customer, how our products and services are governed, and what your rights and responsibilities are - as well as ours.
Welcome to Nifty250 (“the company”, “Nifty250”, “we” or “us”). We have set up these Terms and Conditions ("terms and conditions") to assure you (“the user” or “customer”) that we take your privacy very seriously, and are committed to ensuring that any persons visiting our online service located at the registered domain name www.nifty250.co.za (“the website” or “service”) shall be subject to fair information practices and the protection of their respective privacy. By accessing our website, you hereby understand and agree to be bound by our terms and conditions, and furthermore agree to not download, copy, imitate or display any part of the content found on our website, without the explicit permission and consent of Nifty250.
By utilizing our service located at www.nifty250.co.za you hereby understand and agree that all digital communication shared between us and you is legal and binding. We reserve the right to amend our terms and conditions - including all other policies - at any time, and your use of our website following any amendments will, therefore, represent your agreement to be bound by them.
We would like to make sure that the users utilizing our e-commerce services are old enough to understand them, and therefore we require each user to be eighteen (18) years or older. Please note that by accessing our website, you agree that you are of the required age and therefore are bound to the terms and conditions as set out above.
PRINTS AND PRODUCTION.
We use the best ink and inkjet printing technology to lovingly produce your Nifty250 prints each time you order from us. Your images are printed on a high-quality 250gsm (gram) photographic paper, which will ensure correct ink absorption and adhesion so the prints last.
Each Polaroid Print measures overall 90x105mm, with a square printed surface area of 82 mm x 82mm, Strips measure overall 45x180mm & contain 4 individual images. All orders will be securely packaged in our own Nifty250 packaging. Examples of our images and packaging can be easily viewed on our own Instagram account located here.
Although our printing process strives to accurately render and approximate the user's selected images as best as possible, it is important to note that one cannot simply compare a printed image versus the same image on a digital device with a backlit screen (back-lighted) - the reason being that the backlit screen on most digital devices will always render an image more crisply and clearly given the additional light, which is not available on printed media.
Photographic prints as a general rule of thumb should be kept away from direct sunlight, water exposure, abrasion and or any other extreme environmental condition if one expects a print to last without deterioration.
ORDERS PLACED ON OUR WEBSITE.
We are currently only providing our products and services to the South African (RSA) marketplace, and therefore all our prices are listed as Rands (ZAR) and are not inclusive of VAT.
We reserve the right to make amendments to our prices at any time but guarantee that any confirmed and paid purchases will be carried out before such time. We also reserve the right to cancel any orders that were placed with incorrect details due to errors or malfunctions caused by us or the user.
In the event that we suspect a user to be suspicious and or fraudulent for any reason whatsoever, we reserve the right to cancel any order relating to that user, and furthermore will possibly block the user from using our products and services in the future.
We will strive to make available all our advertised goods and services at all times as best we can, but will not be held responsible should we not be able to do so in any event, for any reason.
CANCELLATIONS.
Any cancellation requests that are received from you the customer thirty (30) minutes after a confirmed purchase has been received, will be deemed unsuccessful and will unfortunately not be accepted as we may have started printing your order. That said, there is a large chance we might not have, and we welcome you to therefore please give us an urgent shout on 021 461 0475 to confirm your order status.
REFUND, DISCLAIMER, AND RETURNS POLICY.
If you are not entirely satisfied with your order from Nifty250 upon receiving it, we invite you to immediately inform our team at hello@nifty250.co.za so we can remedy your situation as soon as possible. Furthermore please note that because of the personal nature of the printed products we produce, we do not accept general returns after a seven (7) day period has elapsed after having had your order delivered.
As a general disclaimer, we reserve the right to decline any requests for reimbursement or compensation for damage, deterioration, or any other issues arising from environmental, or misuse-related factors that are out of the control of Nifty250, to any products and prints purchased from us. We will treat any such case brought to our attention with the greatest of care and fairness, and in all likelihood will always side with you (the customer), but we must state the above in order to ensure that no wild card claims are made.
Finally, we provide a 6-month guarantee from date of purchase on all printed and none-printed products bearing the above disclaimer in mind.
LIMITATION OF LIABILITY.
The website and all content on our website, including any current or future offer of products or services, are provided on an "as is" basis and may include inaccuracies or typographical errors. The Owners make no warranty or representation as to the availability, accuracy or completeness of the Content. Neither Provider nor any holding company, affiliate or subsidiary of Provider, shall be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the Website or any functionality thereof, or of any linked website, even if we are expressly advised thereof.
Whilst every attempt is taken by Nifty250 to ensure your security when making use of the Website, due to the nature of the Internet we are unable to guarantee that any products and services or any websites accessible via the Website are virus- or error-free. We, therefore, caution you to check all emails, attachments, and files before downloading them.
We shall not be liable for any loss, damage, costs or expenses (including loss of profit) arising directly or indirectly from any failure or delay in performing any obligation under these Terms and Conditions by reason of any event or circumstance beyond our reasonable control, including, but not limited to, any strikes, industrial action, failure of power supplies or equipment, government action or Act of God.
INDEMNITY.
You agree to indemnify Nifty250 against all liabilities, claims and legal expenses that may arise out of, or in connection with any breach by you of these Terms and Conditions.
